Wedding Terms and conditions


The terms and conditions apply to any agreement between the client and the photographer 


 


1     A Wedding is only accepted & confirmed on receipt of the official booking form and a deposit. The balance of the Wedding Coverage fee must be paid no later than 12 weeks            prior to the Wedding date. 


2    The client may cancel this contract at any time by giving written notice to the photographer but in doing so shall forfeit any monies paid. Should the photographer receive                     cancellation less than 12 weeks prior to the date of the event the client shall in addition pay a sum equal to 50% of the contract value. The said sum shall be payable as                     compensation as an estimate of the loss the photographer  would suffer. 


3     If the photographer is unable to perform due to circumstances  beyond his control or due to the photographer’s illness or injury, then the photographer shall return the deposit to        the client but shall    


       have no further liability with respect to this agreement. This limitation on liability shall also apply in the event that images are lost through equipment malfunction, lost in the mail 


       or otherwise lost or damaged without fault on the part of the photographer.


4     In the event that the photographer fails to perform for any other reason, the photographer shall not be liable for any amount in excess of the photographer’s fee.


5     The photographer will document the events in a candid manner and take formal portraits as necessary. The client should provide a full list of formal photographs required                    including names and relationship to the client.


6a   Prior to or during the event, the client may inform the photographer of subjects which they would like photographed, but the final content of the images is at the discretion of the          photographer. 


6b   The client should agree with the superintendent registrar or the authorised person (for example, an authorised vicar or priest) on any restrictions they may impose on the                    photographer, then pass this information on to the photographer no less than 14 days before the wedding date.


6c   The photographer cannot be held responsible for any photographic restrictions applied during your wedding coverage or any weather conditions that prohibits the photographer          from carrying out his work.


6d   The images may be supplied with different treatments i.e. black-and-white. The treatments will be at the discretion of the photographer.


7     The Client will ensure that the guests at the event do not interfere with the photographer’s work.


8     When using digital photography, the photographer(s) will be under no obligation to display the images while the event is still underway.


8a   USB are edited and supplied on a USB card cropped at 7×5 or 10x5. Images are supplied in JPEG format and in high resolution.


9a   The Client shall assist and cooperate with the photographer in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be                           photographed; taking  time to pose for photographs at the photographer's direction; providing a person to guide the photographer to desired persons and/or scenes; pre-shoot           consultations, etc. The photographer  shall not be responsible for photographs not taken as a result of the client's failure to provide reasonable assistance /cooperation or is              unable due to circumstances beyond the photographers control. 


9b   The final content of all the images taken or supplied at the event is at the discretion of the photographer. 


9c   The Photographer cannot work when laser lights are being used as this can damage camera equipment.  


10   The photographer retains copyright in the photographs, and hereby grants the client unlimited but non-exclusive rights to use or reproduce the photographs for which the client          pays.


11   Traveling charges will apply outside of the NP post code. This will be reflected in the photographers fee. Local location is within the NP post code


12   Payment-The client’s payment to the photographer shall be as follows: A deposit is due on booking. The remainder of the photographer’s fee (Package price minus deposit) is            payable 12 weeks before your wedding day. Any other products purchases ie USB. must be payed for within 14 days of the invoice. If payment is not made by the due date, we          reserves the right to charge Statutory Interest on the overdue balances for the period from the date on which payment became due until the date on which payment is made. 


       In addition each overdue invoice will attract a late payment compensation fee of £40.


13   Proofs will be available approximately 6 weeks after the wedding date and will be available to view and purchase online for 30 days in your own private album.  "Free online              album" is available  for 30 days only


14   The photographer will maintain backup copies of the images in their archive for a period of one year at which time the client may request all original files on CD at a cost.


15   Pre wedding shoot would take place at Tredegar House Newport this can take place at another location but a traveling fee is charged. Photos are not included on the wedding            USB and are purchased separately.


 


General Terms and conditions

1. If the photographer is unable to perform due to fire or other casualty, strike, or other cause beyond the control of the parties, or due to the photographer’s illness or injury, then the photographer shall return any monies all part payment to the client but shall have no further liability with respect to any agreement. 

1a. This limitation on liability shall also apply in the event that images are lost through equipment malfunction, lost in the mail or otherwise lost or damaged without fault on the part of the photographer.

3. All photographs will be available to view and purchase online.

3.a All photo copyrights remain the property of Stephen James (remember to smile photography) unless otherwise stated in writing

3.b With the exception of human portraits, remember to smile photography or a third party which has written permission, may use photographs in advertising or publications. 

4. Time quoted in all packages is a guide. 

5. It is the clients responsibility to ensure the Hilite Home studio can be assembled in your home. 

6. No responsibility will be taken on any breakages as a result of the home studio assembly or disassembly, although due care and attention will be taken. 

7. All payments must be made in advance which are non-refundable 

8. All packages are not transferable. 

9. It is the client’s responsibility to book any further sessions which will be subject to availability. Once the first photo session has taken place any subsequent sessions must be taken with in a 12 month period.

10. The first year package: The last session the ‘baby’s birthday month’ this may not be taken on the baby’s birthday or birthday party unless agreed when booking the collection.

11. Equestrian package: Traveling charges will apply outside of the NP post code. Payments must be made in advance which is non-refundable. The package is not transferable. If the package has been booked for an outside location the photographer may have to cancel the appointment due to poor weather conditions, notice time of cancellation will be made by phone on the number the client provided at least four hours prior to the appointment.

12. Sports package: Traveling charges will apply outside of the NP post code. Payments must be made in advance which is non-refundable. The package is not transferable. If the package has been booked for an outside location the photographer may have to cancel the appointment due to poor weather conditions, notice time of cancellation will be made by phone on the number the client provided at least four hours prior to the appointment.
